By registering for the 2025 33rd Street Fair, I agree to the following terms and conditions. I acknowledge that these terms are designed to help keep the event safe, successful, and enjoyable for everyone, and to support the efforts of the organizers and the 33rd Street Business Improvement District.

My assigned location, and participation in the event, are at the sole discretion of the 33rd Street BID and event management.
I agree to comply with all event rules, regulations, directions, and instructions provided by event organizers. I understand that failure to comply with these conditions may result in removal from the event without refund or recourse, at the sole discretion of the event organizers.
The 33rd Street BID and event organizers reserve the right to reject any application for any reason and refund payments, less contributions.
3. Registration and Payment
Full payment of all applicable fees is required at the time of application to secure Vendor space at the event. Space will not be reserved until full payment is received.

Vendors retain all proceeds from their own sales.

Legal Compliance: Vendors are responsible for adhering to all federal, provincial, and municipal regulations, including, but not limited to, taxes, insurance, business licensing, and health/safety certificates.
Insurance: Vendors are to carry adequate general liability insurance and property coverage. The 33rd Street BID and all its partners are not responsible for any losses, damages, or theft relating to vendor participation.
Permits & Approvals: Vendors must obtain all necessary permits, licenses, inspections, and certificates for the sale of their items, whether goods or food sales, including health and safety labeling. Copies must be provided if requested.

8. Event Changes, Cancellations, and Liability
All fees paid are non-refundable. The 33rd Street BID and event organizers have no obligation to refund any payments, including in cases of a Vendor's withdrawal or inability to attend, or due to event cancellation or modification, except as otherwise required by law. This includes cancellation, delay, or early closure due to adverse or hazardous weather.
The event is Rain or Shine, and no refunds will be issued due to weather-related conditions unless required by law.
The 33rd Street BID and event organizers reserve the right to cancel, postpone, curtail, modify, or stop the event at any time without liability for damages or refunds if such action is due to causes beyond their reasonable control, including but not limited to extreme weather, public health or other emergencies, safety or security concerns, or other events that jeopardize the event's safety or feasibility.
9. Organizer's Rights and Enforcement
The 33rd Street BID and event organizers reserve the right to:
10. Assumption of Risk, Release of Liability, and Indemnification
Assumption of Risk: The 33rd Street Fair will proceed Rain or Shine. Vendors are responsible for preparing their booth and merchandise for all weather conditions and for their own personal comfort. By participating, I acknowledge and voluntarily assume all risks associated with the event, including but not limited to:
Release of Liability: In consideration of being granted permission to participate as a Vendor in the 33rd Street Fair, I hereby for myself, my heirs, executors, administrators, or any others who may claim on my behalf:
Indemnification: I agree to indemnify, defend, and hold harmless the 33rd Street BID and the Released Parties from any and all liability, loss, claims, demands, costs, and expenses, including reasonable legal fees, due to any personal injury, illness, loss of life, property damage, or any other kind of damage whatsoever arising from my participation as a Vendor in the 33rd Street Fair. This includes, but is not limited to, claims arising from:
Exception: Nothing herein waives liability for gross negligence or willful misconduct, where such waiver is prohibited by law.
11. Limitation of Liability
I acknowledge that under no circumstance shall the 33rd Street BID or event organizers (including the Released Parties) be liable to me or any other person or entity for special, incidental, consequential, punitive, exemplary, or indirect damages, including but not limited to, loss of goodwill or business profits, work stoppage, data loss, equipment failure or malfunction, or any other commercial damages or loss that may arise from my participation in the event. Every vendor experience is different, and commercial outcomes are not guaranteed.
The total liability of the 33rd Street BID and event organizers to any vendor for any and all claims arising out of or in connection with these terms and conditions or the event shall not exceed the total amount of fees paid by the vendor for participation in the event.
12. Media Consent
In consideration of being granted permission to participate in the 33rd Street Fair, I grant the 33rd Street BID and its authorized representatives the irrevocable, perpetual, worldwide, and royalty-free right and license to capture and use my image, voice, and likeness, as well as images and audio/visual representations of my booth, merchandise, and any individuals associated with my booth (including booth representatives or anyone working there).
This includes the right to reproduce, display, distribute, publish, and create derivative works from such captured materials for any purpose, including promotional, marketing, and archival uses, in any media now known or hereafter developed, without further compensation or notification. I waive any rights to inspect or approve such materials, and acknowledge that they may or may not identify me or my booth representatives as the subject or owner.
Vendors who wish to opt out of media coverage must submit a written request to [email protected] by August 31, 2025.
13. Non-Waiver of Rights
The failure of the 33rd Street BID or event organizers to enforce any provision of these terms and conditions shall not be construed as a waiver of such provision or the right to enforce such provision at a later time. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
14. Severability
If any part or provision of these terms and conditions is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
15. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the Province of Saskatchewan.
16. Acceptance of Terms
By completing the registration process and/or participating in the 33rd Street Fair, I acknowledge that I have read, understood, and voluntarily agree to be bound by all the terms and conditions set forth in this document.

- Event: Refers to the 33rd Street Fair.
- Terms and Conditions: Refers to this entire document, including all its sections, provisions, and any attached schedules or addenda, which together constitute the binding agreement between the Vendor and the 33rd Street BID regarding participation in the Event.
- Vendor: Refers to any individual, business, or entity participating in the 33rd Street Fair as an authorized seller of goods or services.
- Released Parties: For the purposes of this agreement, "Released Parties" shall collectively refer to the 33rd Street Business Improvement District ("33rd Street BID"), its officers, directors, staff, employees, agents, volunteers, contractors, sponsors, partners, representatives, successors, and all other entities or individuals directly or indirectly involved in the organization, management, promotion, or execution of the 33rd Street Fair.
2. Event Overview

- Date: Saturday, September 13th, 2025
- Event Time: 10:00 AM - 5:00 PM
- Load-in: Begins at 7:00 AM
- Take-down: Begins at 5:00 PM
3. Event Participation

5. Setup, Operations, and Tear-down
Schedule & Setup:
- Booth setup is between 7:00 AM and 10:00 AM on Saturday, September 13th, 2025 .
- Visit the INFO Tent by The Flag Shop at 7:00 AM to check in.
- Vehicle Access for Unloading:
- Vehicle access for unloading opens at 7:00 AM.
- Vehicles must be unloaded quickly into your assigned space and immediately moved off-site. Do not begin setting up your booth until your vehicle is parked off-site.
- All vendor vehicles must be COMPLETELY off the event site by 9:00 AM. The barricades will close to all vehicular traffic at this time.
- Vendors arriving after 9:00 AM will be unable to drive onto the site and must carry their items from the nearest available parking.
- Vendors must be fully set up and ready to receive visitors by 10:00 AM.
- Vendors agree to remain fully set up and operating until the fair ends at 5:00 PM, unless early take-down is necessary due to safety concerns, risk of property damage, or at the direction of event organizers in response to unforeseen circumstances.
- Vendors must have all items off-site by 7:00 PM, leaving the street in the condition it was before their arrival.
- Vendor ticket includes booth space only. No equipment, power, or water is provided.
- Vendors agree to provide their own equipment, power, water, and all other necessary items.
- Vendors agree to set up within their assigned space and maintain a clean, professional area at all times.
6. Event Rules
- No subleasing, reselling, or sharing of space without written approval.
- Tents must be in good repair and secured with proper weights (40 lbs on each tent leg recommended).
- Only quiet generators are permitted.
- Clean up all garbage and dispose of it in the large black 300-gallon garbage bins provided along 33rd Street. Do not leave garbage or other items anywhere in the 33rd Street BID.
- Recycle and compost all eligible items. Use recyclable and compostable containers and materials whenever possible.
- No amplified sound, disruptive behavior, aggressive solicitation, or harassment is allowed.
- No smoking, drinking, or possession of alcohol or illegal substances onsite.
- No sale of alcohol, chemicals, weapons, fireworks, or illegal items permitted.
- Vendors agree to help create a welcoming and safe environment for everyone, regardless of race, gender, age, ability, religion, sexual orientation, or background.
- Neither vendors, nor anyone representing their business, will engage in any form of hateful language, harassment, or discrimination. Vendors will treat all participants, staff, and visitors with respect and courtesy at all times, and strive to create a positive and inclusive community experience.
7. Compliance & Vendor Responsibilities

Food Safety (if applicable):
- Vendors must provide all required health and safety supplies needed in their operations (e.g., handwashing stations, cold storage, etc.) and ensure all staff maintain high cleanliness standards.
- All food sales and sampling must be pre-approved by Saskatoon Public Health Authorities and event management.
- A Temporary Food Service Event Vendor Application, if required, must be submitted to [email protected] by August 12, 2025. Failure to do so may result in non-permission to participate and forfeiture of fees.
- Recommendation: Vendors are encouraged to contact the Saskatchewan Health Authority before committing to the 33rd Street Fair to ensure compliance. Information on Food Handling and Food Safety Courses is available through the Saskatchewan Health Authority.

- Remove or prohibit any items from being sold at any time, at their sole discretion.
- Charge vendors for cleanup costs or damages if their site is not left in proper condition.
- Remove, ban, or restrict any vendor, and terminate their participation without refund, for violation of these terms, event rules, or any applicable government regulations.
10. Assumption of Risk, Release of Liability, and Indemnification
Assumption of Risk: The 33rd Street Fair will proceed Rain or Shine. Vendors are responsible for preparing their booth and merchandise for all weather conditions and for their own personal comfort. By participating, I acknowledge and voluntarily assume all risks associated with the event, including but not limited to:
- Weather conditions (e.g., strong winds, rain, heat, smoke).
- Environmental exposure.
- The inherent unpredictability of public outdoor gatherings.
- The possibility of event cancellation, postponement, curtailment, modification, or stopping due to emergencies, adverse conditions, or other causes beyond our reasonable control.
- Personal injury, illness, or death.
- Loss, theft, or damage to my property, including cash, merchandise, equipment, and personal belongings, regardless of cause (including weather or actions of third parties).
Release of Liability: In consideration of being granted permission to participate as a Vendor in the 33rd Street Fair, I hereby for myself, my heirs, executors, administrators, or any others who may claim on my behalf:
- Release, waive, and hold harmless the Released Parties from any and all claims, demands, actions, or liabilities for any loss, injury, damage, or expense I may suffer, whether arising from negligence or otherwise, except as prohibited by law.
- Covenant not to sue the Released Parties, for myself, my heirs, executors, administrators, or any others who may claim on my behalf.
- Waive the right to pursue any form of legal action or compensation related to these risks, including claims for lost sales, adverse weather impacts, or cancellation or modification of the event.
Indemnification: I agree to indemnify, defend, and hold harmless the 33rd Street BID and the Released Parties from any and all liability, loss, claims, demands, costs, and expenses, including reasonable legal fees, due to any personal injury, illness, loss of life, property damage, or any other kind of damage whatsoever arising from my participation as a Vendor in the 33rd Street Fair. This includes, but is not limited to, claims arising from:
- Any act or omission by me or my representatives.
- Any breach of these terms and conditions by me or my representatives.
- Any injury to persons or damage to property caused by me or my representatives.
- Any violation of laws, regulations, or third-party rights by me or my representatives.
Exception: Nothing herein waives liability for gross negligence or willful misconduct, where such waiver is prohibited by law.
